Land subdivision and re-parcelling

If you are dividing a plot between heirs, selling part of it or want to merge several plots, the change to boundaries and shape is handled through a surveying procedure and the cadastre.

Subdivision, re-parcelling and merging — what is the difference

When subdivision is done

  • Inheritance: co-owners each want their own part.
  • Selling part of a plot: the buyer buys a new, separate plot.
  • Construction: the planning document requires an urban planning plot of a different shape.
  • Tidying up: you merge several small plots you own into one.

Procedure

  1. First check the plots in eKatastar and the planning document (DUP — detailed urban plan / spatial-urban plan (PUP)) that applies to the location.
  2. Agree the boundaries with the co-owners. A division by agreement needs everyone's consent.
  3. The land surveyor (geometar) visits the site, takes measurements and prepares a proposal for the new boundaries.
  4. The surveyor then prepares the subdivision survey report (elaborat) and submits it to the cadastre.
  5. An application to register the new subdivision is submitted, together with the relevant contract in the case of a sale or division.
  6. Once the procedure is complete, the cadastre registers the new plots and their numbers.
  7. If needed, the surveyor marks the new boundary points on site.

Subdivision under a DUP or PUP

For construction, a cadastral plot alone is not enough — it must match the urban planning plot in the planning document. If the cadastral and urban planning boundaries do not match, a conditional subdivision is carried out. Check the plan with the municipality or on the planning documents portal. What UTU and DUP are.

Can one co-owner request a division without the others?

A division by agreement requires everyone's consent. Without it, the division is decided in court proceedings, and the surveyor then works on the court's instructions.

Does a new plot automatically become building land?

No. Whether you can build is determined by the planning document, not by cadastral subdivision.
