Unit division of a building and registration of separate units

Unit division (etažna razrada) — the division of a building into separate units — defines the separate units of a building (flats, commercial premises, garages) as well as its common parts. After the procedure, each separate unit can be registered on its own.

When unit division is done

  • A developer is selling flats in a new building.
  • You have bought a flat, but only the building is recorded on the property certificate (list nepokretnosti).
  • A family house has two or more flats that you want to register separately (e.g. for inheritance or sale).
  • An extension or conversion of an attic into a flat.

What the unit division procedure involves

  1. The surveyor surveys the building floor by floor and measures each separate unit.
  2. They prepare a unit division survey report: floor sketches, areas, labels for the separate units and common parts.
  3. The survey report is submitted to the cadastre for review.
  4. The owners file an application to register their rights to the separate units, together with the contracts.
  5. Each flat gets its own entry on the property certificate.

Why the area in the cadastre differs from the listing

The cadastre records the area measured according to the rules for separate units. Listings often quote an area that includes terraces, walls or common space. A difference of a few square metres is common — check it before buying.
